These Service Terms apply to Internet service provided by Florida Broadband, Inc. (“Florida Broadband,” “we,” “us”) to residential and business customers. By ordering or using our service, you agree to these terms. Pricing and plan details for each plan are shown on our Broadband Facts labels.
1. Service agreement and term
- All Internet plans require a 12-month service agreement. The term begins on the date your service is installed.
- After the initial 12 months, service continues month to month at the then-current price unless you or we cancel.
- Monthly prices shown are not introductory rates.
2. Pricing, billing and taxes
- Service is billed monthly in advance. Payment is due by the date shown on your invoice.
- Government taxes are included in the monthly price of Internet service. Optional VoIP phone service is billed at $25.00 per line per month plus applicable taxes and fees.
- Optional Managed WiFi is $10.00/month for the first router and $3.00/month for each additional router.
- One-time fees: Installation $150.00; Router purchase $150.00 (if you buy a router from us).
- Accounts more than 30 days past due may be suspended until the balance is paid.
- We will give you at least 30 days’ notice before changing the price of your plan.
3. Early termination
If you cancel before the end of your 12-month term, an early termination fee equal to 50% of the monthly charges remaining in the term will apply. Example: cancelling a $65/month plan with 4 months remaining = 4 × $65 × 50% = $130. No early termination fee applies if you move to an address we cannot serve and provide proof of the move, or after the initial term ends.
4. Data allowances and additional data
- Residential Bronze includes 500 GB of data per month. Residential Silver includes 1 TB (1,000 GB) per month.
- All other plans (Residential Gold and Platinum, all Business and Fiber plans) include unlimited data.
- On plans with an allowance, data used beyond the allowance is billed at $0.50 per 1 GB. We will make a reasonable effort to notify you when you reach 90% of your allowance.
- Unused data does not roll over. You may upgrade to a higher plan at any time without penalty.
5. Speeds and availability
Speeds are advertised as “up to” and typical speeds are shown on each Broadband Facts label. Actual speeds vary with signal path, weather, equipment, WiFi conditions, the number of connected devices and network traffic. Some plans (including Platinum and Fiber) are available only in select areas; service availability is confirmed at installation.
6. Equipment and installation
- Outdoor radio equipment installed by Florida Broadband remains our property unless purchased, and must be returned or made available for pickup when service ends.
- You grant us reasonable access to your premises to install, maintain and remove equipment.
- You may use your own router. Managed WiFi support covers only routers provided and managed by Florida Broadband.
7. Acceptable use
You may not use the service for unlawful activity, to send spam, to attack or disrupt other networks, to infringe intellectual property, or to resell service without our written consent. Residential plans are for residential use. We may suspend service that threatens the security or performance of our network. See our Network Management Policy.
8. Service interruptions
We work to keep service running 24/7, but service may be interrupted by weather, power outages, maintenance, or events beyond our control. If an outage caused by our network lasts more than 24 consecutive hours after you report it, you may request a prorated credit. Business customers needing guaranteed uptime should ask about our Redundancy service.
9. Limitation of liability
Service is provided “as is.” To the extent permitted by law, Florida Broadband is not liable for indirect, incidental or consequential damages, and our total liability is limited to the amount you paid for service in the month in which the claim arose.
10. General
These terms are governed by the laws of the State of Florida. We may update these terms with at least 30 days’ notice posted on this page or sent to you. Our Privacy Policy and Discounts page are part of these terms.
